I am still here in the Philippines but I already passed the NCLEX under NY BON, then recently, I found an employer in CT, and he advised me to endorse my license first before we do the paperworks for I-140. I mailed CT my application form and also mailed NY my request for verification. What i want to know is, what other docs should i pass to CT? Will a transcript from my school here in the Philippines suffice? Or do I have to take the CGFNS CP? Please help....Another thing, is it true that we can not go through the filing of my i-140 unless my license is already endorsed from NY to CT? Hope you can give me guidelines on how we can go through this...I know my employer's lawyer should know how to do it...but i don't want to risk the processing of my papers since he looks like he's not so sure of what he's doing. If you can give me an advice about how we can go through this, then I can tell him what needs to be done. Thanks a lot! Good to know there are people who's willing to extend their hand for nurses in need. Thanks again!

You have an intersting problem. First, it is our understanding that you cannot endorse the NY license to Connecticut until it is actually issued. The license cannot be issued until you receive a social security number. The social security number cannot be issued until you have completed the immigration process and been issued a visa.
It appears that you are looking at trying to requalify in Connecticut rather than endorse. In all cases, it is wise to go to the State BON website to review the licensure requirements for foreign educated nurses.
The key problem that you have is the request by your future employer that you get a CT license prior to processing the I-140. One can only assume that the employer has experienced problems with the process before. As long as the CT employer insists on that approach, you will have to go through the CT BON process as described on their web site.

married wnating to get parents to US

hi i have a friend who is already married and also an NCLEX-RN passer. She would like to know if she can petition her husband and parents at the same time and how long will their papers be processed or how long will her dependents be able to go to US??

My nurse recruiter is from Bakersfield, I got interviewed by the employer last July and got the job. The recruiter sent the job offer w/c included the salary, sign on bonus or immigration package and a relocation bonus which will be on promissory note unless i finish the 2 year contract...
He emailed me and said he is on the process of filing of I-140 with the immigration lawyer and paid 3,500 dollars this October. Is this the amount of the immigration right now? Is the job offer letter already a binding contract in my case? Does this nurse recruiter trust us that much? Can you give me an example of a good contract?

Good Morning,
I am very happy that you are interested in working in the US. In regard to your questions:

1. Immigration Rules for Dependents and Families- These rules change from time to time but the current state of affairs is as follows:
a. When the nurse receives her visa, her spouse and children under the age of 18 are eligible to receive a visa at the same time. The visa comes with the right to work so that the spouse may get a job. You should list your dependents on the I-140 when it is submitted.

b. The waiting time for parents to come over as relatives changes almost monthly but it requires many years. File as soon as you receive your green card but expect that it may take 7-10 years under current law. Some of the proposed reforms limit this even further.

2. Temporary Licensure-States in the US issue the licenses and there are no "temporary" licenses. When you receive your license you may then apply for endorsement to another state.

I am troubled by your questions. Basically you have agreed to accept employment in US and the agency is in the process of preparing your immigration filing. You note that the recruiter has already spent money on your behalf.

I interpret your questions as seeking direction as to how to break your commitment. Understand this very clearly, when a recruiter makes an agreement with you, he begins to incur costs on your behalf. This is his own money. For you to not honor that commitment is like taking money under false pretenses. It is unethical.

oh sorry for my troubling thoughts..i have no intention of breaking my contract with my recruiter...i just want to ask if thats how much a recruiter really pays, 3,500 dollars to the immigration lawyer? because that will be deducted from my sign on bonus..

also, is that job offer letter enough proof that it is as binding as not signing in the presence of an attorney? i just hope you can enlighthen me what a good contract includes?, because i think i have a good one too...

i also think its unethical to withdraw it also....and the trouble of my recruiter spending ahead with the retrogression ongoing, looks recruiters are also pressured but cant do anything about it..pls comment...

to whoever who can help me,

i am confused!

i am in the US now on tourist visa and i learned that i cannot work until i have atleast the work permit. My question is. if my agency files my I-140 while im still here then i decided to go back to the Philippines before the petition is approved, can I still go back here on a tourist visa by next year if the non-immigrant visa becomes available then have a adjustment of status?

furthermore, if my I-140 is filed now then i went back to the Philippines and got married. Can i still include my husband in my petition (i-140) so he can have his green card at the same time that i will receive my green card? what should i do or file as soon as we got married for him to accompany me in the US immediately?

I'm have a ducht passport and live in the carribean. A nurse recruiter told me that I could file a I-40 and after 3 months come and live ( as a tourist) in USA since I have a 3 months visa stay in my passport. Than she will file a adjustment of status for me and I could be working in the next 100 day's. Is this legal? How to find a legal adviser on those subjects?
I could do it but what is the chance that after 100 I can't work?

nclex passer want to endorse

hi.. i already passed nclex-rn california..would it be possible for me to endorse and get my license @ another statelike virginia or texas?? if yes.. can someone please enlighten me on how to do it??? will be waiting for replies... thanks...

having your i-140 (immigrant working visa) approved after 3 months is not possible at this time due to retrogression. if there is retrogression, you have to wait for retrogression to be lifted before that 3 month processing time occur. nobody knows when retrogression will be lifted..it could even take years. Find an immigrant lawyer in the US if you want to make sure about this..i think this site has list of immigrant lawyers.
